DT Fitness, Inc. ("Onyx Fitness," "we," "us," or "our") operates the website onyxfitkc.com and the Onyx Fitness facility at 255 N Stone Creek Dr, Gardner, Kansas 66030. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. It applies to our website and to information we collect in connection with your membership and visits.
Information we collect
Information you provide directly. When you book a tour, become a member, or contact us, you may provide:

• Mailing address (for membership)
• Date of birth (for membership)
• Emergency contact information (for membership)
• Payment information (processed by our gym-management and payment providers; we do not store full card numbers ourselves)
• Any notes or messages you send us

• Approximate location (city or region, based on IP address)
Information from third parties. Membership billing and management are handled by Health Club Systems. Information you provide to them in connection with your membership may be shared with us as needed to operate the facility.

Our website uses cookies and similar technologies for two purposes: (1) essential cookies required for basic site functionality and security, and (2) analytics cookies that help us understand how visitors use the site.

We send marketing emails only if you have opted in. You can opt out at any time using the unsubscribe link in any marketing email or by contacting us. We will still send transactional messages related to your bookings or membership.
Accounting and financial data
We use QuickBooks Online, a product of Intuit Inc., for our business accounting. Our administrative tools connect to our own QuickBooks company through Intuit's secure, authorized connection and access financial records — such as revenue, expense, and accounts-receivable summaries — on a read-only basis. We use this information solely for our own bookkeeping, reporting, and business analytics. We do not sell it, and we do not use it to make automated decisions about you. Access is protected by Intuit's authorization process, and our credentials are stored securely.
How we share information
We do not sell your personal information.
We may share information with:
• Service providers who help us operate — including our gym-management and membership software (Health Club Systems), payment processors, accounting software (Intuit / QuickBooks), email delivery services, website hosting, and analytics providers. These providers may use your information only to provide services to us.
• Professional advisors, such as our accountant or attorney, when reasonably necessary.
• Legal authorities when required by law, subpoena, or legal process, or to protect the rights, safety, or property of Onyx Fitness, our members, or the public.
• Business transfers — if we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
Data retention
We keep your information for as long as needed to provide our services, comply with our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. Tour-booking information is generally retained for about 2 years. Membership and financial records are retained as required by applicable law, generally up to 7 years after your membership ends. When information is no longer needed, we take reasonable steps to delete or de-identify it.
Your rights and choices
Depending on where you live, you may have the right to access, correct, delete, or restrict the use of your personal information, and to opt out of marketing. To make a request, contact us using the details below; we may need to verify your identity before responding, and we will respond within the time required by applicable law.
Kansas residents. Kansas does not currently have a comprehensive consumer privacy law, but we honor reasonable requests to access or correct your information.
California residents. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, and opt out of the "sale" or "sharing" of personal information. We do not sell or share personal information as those terms are defined under the CCPA, and we will not discriminate against you for exercising your rights.
Security
We use reasonable administrative, technical, and physical safeguards — including encrypted connections and restricted access to our systems — to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
Children's privacy
Our website and services are intended for adults. Membership and website transactions are limited to individuals 18 years of age or older. Minors may use the facility only when accompanied and supervised by a parent, legal guardian, or member who is responsible for them. We do not knowingly collect personal information from children under 13; if you believe a child has provided us information, contact us and we will delete it.
